Home inspections during a divorce

Understand a home’s condition before planning repairs, a sale or a buyout. An inspection is different from an appraisal.

What this professional does

A home inspector documents observed property conditions within an agreed scope. During a divorce, that information can help you discuss repairs before listing a home or considering a buyout. It does not decide who pays for repairs or who owns the property.

An inspection is not a market-value appraisal. Agree with your attorney and the other authorized decision-maker about access, the purpose of the report and who receives it. Seek separate specialist advice when a finding needs further investigation.

When to seek this help

  • Preparing a jointly owned home for sale.
  • Considering retaining the home through a buyout.
  • Investigating condition concerns before budgeting for repairs.

How to prepare

  • Arrange lawful access with the owner or occupant.
  • Gather known repair records and prior reports you are entitled to share.
  • List concerns and agree who will receive the report.

Questions to ask before hiring

  • What systems and accessible areas does the inspection cover?
  • Which specialty inspections cost extra?
  • What relevant training, experience and insurance do you have?
  • When will the written report be available, and can you explain its limitations?

Checking qualifications

  • Review the written scope, exclusions and a sample report before hiring.
  • Confirm qualifications for any specialty work, service area, fees and availability directly; a directory entry is not a license check.

Limits of this role

  • An inspection cannot guarantee the absence of hidden defects or future failures.
  • Inspectors do not provide divorce legal advice, establish property value or allocate repair costs between spouses.

Frequently asked questions

Is a home inspection the same as an appraisal?

No. An inspection addresses observed condition within its scope; an appraisal addresses value for a stated purpose and date. Your circumstances may call for both.

Can I arrange access without telling the other spouse?

Do not assume you have authority. Coordinate access and report sharing with your lawyer and any other person whose permission is required.

Are sewer, mold or pool inspections included?

Not necessarily. Ask for a written list of included services and separate fees before agreeing to the inspection.
