Selling or buying a home during divorce
When the house is at the center of a settlement, an agent who can stay neutral and communicate with both spouses matters.
What this professional does
A real estate agent can advise on market value, prepare and list the family home, and manage a sale when both spouses must agree on every step. In divorce, the hard part is often communication: two sellers who may disagree on price, timing and repairs.
Some agents hold the Certified Divorce Real Estate Expert (CDRE) designation from the Ilumni Institute, which describes it as training agents to be the neutral real estate expert divorcing homeowners and family law attorneys rely on. It is a private designation. The license to act as a real estate agent in California comes from the Department of Real Estate.
When to seek this help
- You have agreed, or the court has ordered, that the home will be sold.
- One spouse wants to keep the home and you need a realistic sense of market value.
- One or both spouses need to buy a new home after the divorce.
- You need someone who will send identical updates to both sides.
How to prepare
- Current mortgage statements and any home equity line balance.
- The grant deed and property tax bill.
- Any court orders or written agreements about the home.
- A list of known repairs and improvements, with dates.
- Agreement between spouses, or between counsel, on how decisions about price and offers will be made.
Questions to ask before hiring
- What is your California DRE license number?
- Will you communicate equally with both spouses, and in writing?
- How do you handle disagreements on price or offers?
- Have you sold homes subject to a court order or attorney oversight?
- How is your commission structured, and who pays it from the proceeds?
Checking qualifications
- Verify the agent's license with the California Department of Real Estate.
- If they cite the CDRE designation, confirm it with the Ilumni Institute. It does not replace the DRE license.
Limits of this role
- An agent's market opinion is not a formal appraisal. If value is disputed, see property appraisals.
- Agents cannot advise on how the sale affects property division or taxes. Ask your attorney and tax adviser.

Frequently asked questions
Can we sell the house before the divorce is final?
Sometimes, but the summons in a California divorce includes standard restraining orders on transferring property without written consent or a court order. Talk to your attorney before listing.
Is a CDRE agent required?
No. It is an optional private designation. What matters most is a valid DRE license, relevant experience and a clear plan for communicating with both spouses.
Should each spouse have their own agent?
When the home is jointly sold, a single listing agent acting even-handedly is common. For later purchases, each person normally chooses their own agent.
