Dividing retirement accounts and QDROs in divorce
Retirement benefits are usually divided by a separate order that the plan itself must accept. One size does not fit every account.
What this professional does
Retirement savings are often among a household's largest assets. The U.S. Department of Labor publishes a guide on dividing private employer plan benefits through Qualified Domestic Relations Orders (QDROs). A QDRO preparer, often an attorney or specialised drafting service, writes an order that fits both the settlement and the specific plan's rules.
Requirements are plan-specific. The Department of Labor explains that plans must adopt reasonable procedures for deciding whether an order is qualified, and the plan administrator makes that determination. Government, military and individual retirement accounts follow different rules again, so a QDRO is not the right document for every account.
When to seek this help
- The settlement divides a 401(k), 403(b), pension or similar employer plan.
- You need to understand whether a pension is valued now or divided as it is paid.
- A judgment was entered years ago but the retirement order was never finished.
- A plan administrator rejected a draft order.
How to prepare
- The exact legal name of each plan and the plan administrator contact details.
- Recent account or benefit statements.
- The plan's QDRO procedures and any model order the plan provides, which you can usually request from the administrator.
- The relevant sections of your judgment or settlement.
- Dates of marriage and separation as stated in your case.
Questions to ask before hiring
- Do you draft orders for this type of plan, including government or military plans if relevant?
- Will you send a draft to the plan for pre-approval before it goes to the court?
- Is filing with the court and submission to the plan included in your fee?
- How do you handle survivor benefits and gains or losses after the valuation date?
- Who do I contact if the plan rejects the order?
Checking qualifications
- If the drafter is an attorney, check their State Bar profile. Non-attorney drafting services cannot give legal advice.
- Confirm the plan's own procedures directly with the administrator. Only the plan determines whether an order is qualified.
Limits of this role
- The order must match the settlement. If the settlement language is unclear, the QDRO cannot fix it alone.
- Tax consequences of distributions vary. Ask a tax professional before taking money out.

Frequently asked questions
Is a QDRO needed for an IRA?
IRAs are not employer plans and are generally divided under different rules. Ask the account custodian and your attorney what document they require.
Why does the plan matter so much?
Each plan has its own procedures and options. The Department of Labor guide explains that the plan administrator decides whether a particular order is qualified under the plan's procedures.
When should the QDRO be prepared?
Many attorneys prefer to start it alongside the settlement so that the language works for the plan. Delays can create problems if a participant retires, dies or changes jobs.
